Terms of Business

There are no fees until Cupcakes Nanny Agency has found a suitable Candidate and employment has been
confirmed.

Once a client has registered with Cupcakes Nanny Agency the following terms and conditions apply.

1.       Every effort is made to place a Candidate to suit your requirements. However we cannot be held liable for
        any malpractice carried out by the Candidate.
2.       Once the client has accepted a suitable Candidate, it is the Client’s duty to inform us immediately.
3.       Fees are payable the week before employment commences.
4.       An invoice will be sent to the client the week before employment begins, and it is to be paid in full within
        5 working days. In the event of non-payment within the stipulated period, the Agency shall be at liberty   
        to levy a 10% surcharge on any late payment.
5.       If a nanny, mother’s help, housekeeper, doula, maternity nurse, babysitter fails to commence
        employment, payment has been made and a suitable replacement can not be found, the fee will be      
        refunded to the client.
6.       If a client withdraws employment once an offer has been made and is accepted by the Candidate,
        the fee will become payable in full immediately (subject to circumstances).
7.       If the employment fails to work out within the first 6 weeks and notice by either party has been given, we
        will make every effort to find a suitable replacement free of charge.
8.       Refunds
    a.        Refunds will only be applicable providing the account has been settled in full as described in item 4.
    b.        Should the applicant fail to take up the duties the agency will try to find a suitable replacement.
              If no suitable replacement is found the fee will be refunded.
    c.        Where a permanent engagement is terminated within the first 6 weeks, and no suitable   
              replacement is found 50% of the placement fee is refunded.
9.       Introductions are confidential. Clients passing on information relating to staff introduced to them by the
       agency resulting in subsequent employment will be liable to the full fee.
10.    While the agency endeavours to verify the background of staff introduced before employment  
       commences,  we cannot guarantee that all the information regarding the applicant is accurate. The Agency
       does not accept any liability whatsoever for misrepresentation, loss, damage claims or expenses incurred
       by the Client.
11.    The Client is advised to obtain references to satisfy himself/herself of the Candidate’s suitability. The final
       responsibility for accepting the applicant lies with the Client.
12.    Where the Client has requested that a candidate apply for a new Criminal Records Bureau check,
       Cupcakes will arrange the check on behalf of you, the Employer.
